Default Can you believe it?

Was riding my motor bike along Marylebone Road 10 days ago, pelting down with rain, lots of traffic etc. Anyway the bike went in a pothole, trying to regain a proper balance the van to my right decided to pull to the left, which made me apply the brakes. By this time I'd completely lost control of the bike and promptly hit the tarmac with the bike resting on top of me... No big deal, bit bruised and scratched, however today I received a £130 fine for stopping on a red route lol...

Hope you're going to tell "them" about the pothole in the road that caused your accident and explain you want compensation for the damage it's done to you and your bike as well as a pretty rapid repair of said pothole ....

Also, of course, you realise the "fine" was issued by mistake. Could "they" please confirm by return of email that the fine has been cancelled?

What?.. Did a warden give you a ticket while you were lying in the road or is this CCTV with attitude?

This is why I'd never drive in London, too many weird rules and over zealous traffic wardens

They've just sent me another penalty charge notice wacking it up from £130 to £195 saying I haven't made any representations in response to the original penalty charge notice. Funny how I have aknowledgement email from TFL saying they were in receipt of the appeal and would get back within 15 days

I'm just glad you're ok though. I've had my fair share of bike accidents so, I hope the bruises heal quickly.

What is it with governments though? I mean, could they not see the penalty was not your fault? Or don't they really bother with things like this?

What I like about the recent letter is, it says 'Transport For London' then in brackets ( The Enforcement Authority) it kind of reminds me how much nicer it was growing up in the 70s. Why people want to migrate to this country is beyond me..

If you are up for it Barney the very next thing you want to be doing is going back to the scene of the accident to get photo's of the pot hole -
If you are lucky and the pot hole is still there, park in a nearby car park then go and take as many photo's as you can, have with you a ruler or a universal item (usually something with the Queens head on so people cannot argue about the item, and take picture with the item in the pot hole so that you have evidence of the size of the pot hole.

The next thing i would do is then take the bike to be fully repaired without and expenses spared. Get a detailed receipt.

Next make a small claim against the local council or whoever is responsible for that stretch of road.

It is wrong that is a fact, but you could still have the fine go up and up and up, personally I'd pay it knowing your going to counter sue for damages or get in touch via the contact details on the ticket and inform them of your intention to sue for damages (only inform them after you have the photos) and they might freeze it from going up, or negotiate your counter claim.

Don't get mad, get Justice.

If they know your accident took place it may well be the pot hole is gone, it is for sure worth having a look.

If your cuts and bruises are still visible, take pictures too if poss

I think you were lucky the accident wasn't worse. I find I am looking down half the time looking for pot holes. I am sure if you get a sane person they will see it was an accident.
